$6,600,000 Having a family history of disease is something that all physicians should take seriously. Our client's medical history showed that her unborn baby had a one out of four chance of being born with a rare metabolic disease known as methylmalonic academia. This disease could have not only been prevented with the proper pre-natal tests, but could have been treated had post-natal tests been conducted. Even after the baby displayed numerous symptoms suggestive of the disease, the physicians failed to test for it. This baby suffers from brain damage, cerebral palsy and seizures. A $6,600,000 settlement was agreed upon.

Premature birth that could have been prevented with a sonogram caused our client to give birth to a baby who suffered brain damage. The mother presented symptoms of preterm labor- including cramping, bleeding and cervical incompetence. Although numerous sonograms were conducted prior to her exhibiting symptoms, none were taken on the date of her premature delivery. $6,250,000 was the agreed upon settlement.

$1,931,530.35 Dying from lung cancer after a rheumatologist misread a man's chest x-ray, left his family fatherless. Even though the man had a chronic cough as well as aches and pains in both his knees and ankles (which are both warning signs of lung cancer)- the doctor did not recommend any further diagnostic tests. At the time the x-ray was taken, had the lung tumor been detected, it could have been removed. By the time this man's cancer was diagnosed a year later, it had spread to both lungs. We were awarded a settlement of $1,931,530.35.
$1,700,000 Negligently severing an artery in an elderly man's brain during surgery to remove a tumor caused this client to suffer a debilitating stroke. Had the surgeon utilized the appropriate surgical equipment when performing the surgery, he would have been able to see the artery which was buried in the tumor. The man will spend the rest of his life in a nursing home, in need of constant care and assistance. Our client was awarded $1,700,000.
$1,300,000 Releasing the wrong tendon in an injured woman's shoulder, as well as leaving a foreign body in the woman's shoulder during surgery, left this client with only 50%-60% mobility in her arm as well as numerous other complications. She also now has carpal tunnel syndrome, which is extremely painful. A $1,300,000 settlement was reached.
$875,000 Undiagnosed breast cancer for over two years caused a woman to undergo a mastectomy to remove a large tumor. After feeling he mass in her breast, she went to her doctor for a mammography. Failing to find the tumor, the doctors told her it was normal tissue. Still complaining of the mass, the doctors sent her for a follow up mammography. Six months after being told that everything was normal, her doctor found the tumor. We settled this case for $875,000.
$425,000 Excessive force during a colonoscopy resulted in a ruptured spleen of a woman. The physician performing the colonoscopy did not guide the colonoscope in a gentle, smooth manner. Her spleen had to be removed because of intense abdominal pain. A verdict of $425,000 was awarded.
$375,000 Failure to diagnose pneumonia can often lead to complications, such as in the case of a young boy who suffered a collapsed lung after his doctors failed to diagnose and treat his illness. The boy had to endure surgery, a respirator, a period of induced medicated coma as well as methadone treatment for withdrawal from medications during his recovery. Duffy Duffy and Burdo settled this case for $375,000.
$150,000
A teenage boy complaining of abdominal pain underwent a routine surgery. During the surgery, the doctor cut a hole in the boy's artery which caused the need for a blood transfusion. After several days in intensive care, the boy was released from the hospital. The abdominal pain that caused the boy to have surgery is still present and he now suffers from a condition known as retrograde ejaculation. Duffy, Duffy and Burdo was successful in settling this case for $150,000.
